1Four Core NDA Design Elements

2Raw Material Traceability and Retention

3Data Tiering and Targeted Disclosure
Not all formula data requires identical protection. Classify into three tiers: trade secret level (complete quantitative formula, core supplier lists), internal sensitive level (process flowcharts, QC procedures, inspection checklists), and public level (stability test methods, retention policies). Only the trade secret tier receives the strictest NDA protection; the internal sensitive tier can be shared under a standard confidentiality declaration; the public tier can be shown directly during audits. Targeted disclosure mechanism: for toxicology assessments or regulatory filings, the formulation is transmitted directly from the manufacturer to the assessment body or regulator, bypassing the small brand to reduce leakage risk in intermediate links (subject to the latest regulatory text).
